California Privacy Policy & Notice at Collection

This Privacy Policy describes how Wilshire FundĀ ("we," "us," or "our") collects, uses, and discloses personal information in connection with our business-purpose lending services.
1. Notice at Collection
At or before the time of collection, we collect the following categories of Personal Information for the business purposes of underwriting and originating non-owner occupied, commercial loans:
- Identifiers: Name, alias, postal address, unique personal identifier, online identifier, Internet Protocol (IP) address, email address, Social Security number, driver's license number, or passport number.
- Sensitive Personal Information: Social Security numbers, driverās license numbers, and financial account log-in information (when provided for bank verification).
- Financial & Commercial Information: Bank statements, tax returns, credit reports, and records of real property.
- Internet Activity: Browsing history, search history, and information regarding your interaction with our website.
2. Automated Decision-Making Technology (ADMT)
We may use automated technology to assist in the preliminary assessment of loan applications (e.g., pre-qualification based on LTV or credit score thresholds).
- Your Right to Opt-Out: You have the right to opt-out of the use of automated decision-making technology for significant decisions.

3. Your Rights Under California Law (CCPA/CPRA)
If you are a California resident, you have the following rights:
- Right to Know/Access: You can request a list of the personal information we have collected about you since January 1, 2022.
- Right to Delete: You may request that we delete your personal information, subject to certain legal exceptions (such as our obligation to retain loan records under DRE or financial regulations).
- Right to Limit Sensitive PI: You have the right to direct us to limit the use of your sensitive personal information to that which is necessary to perform our lending services.
- Opt-Out Request Honored: We honor "Global Privacy Control" (GPC) signals. We do not sell or share your personal information for cross-context behavioral advertising.
4. Gramm-Leach-Bliley Act (GLBA) Notice
Much of the information collected during the loan application process is considered "Nonpublic Personal Information" under the federal Gramm-Leach-Bliley Act. As a financial institution, our handling of this data is primarily governed by federal privacy standards and the California Financial Information Privacy Act (FIPA).
5. Data Retention
We retain your personal information for as long as is necessary to fulfill the lending purposes described above, or as required by the California Department of Real Estate (DRE) record-keeping mandates (typically 3 years for most records).
